Terms of Use

1. Welcome and scope

Welcome to The Apartment Chicago. These Terms of Use (“Terms”) govern your use of our website, the booking and account features we provide through our mobile application, and our studio services, classes, workshops, and events, including any online or outdoor experiences we offer (collectively, the “Services”).

The Apartment Chicago is a studio within The Garage Chicago. The Services are provided by [registered legal entity name operating The Garage Chicago], operating The Apartment Chicago (“The Apartment,” “we,” “us,” or “our”). These Terms apply to Services provided by that entity. If a location or event is operated by another entity, its identity and any applicable agreements will be provided before purchase or participation.

Please read these Terms before using the Services. By affirmatively accepting these Terms during account registration, checkout, or another acceptance process, you agree to them. Where permitted by law, continued use following conspicuous notice of these Terms also constitutes acceptance. If you do not agree, please do not use the Services.

2. Other agreements and privacy

Your use of the Services may also be subject to a separately accepted membership agreement, participation waiver, purchase terms, event terms, or promotion terms. The specific agreement governs the subject it addresses if it conflicts with these general Terms, subject to applicable law.

Our Privacy Policy, available at [privacy policy URL], explains how we collect, use, and disclose personal information. Accepting these Terms does not by itself provide consent to optional marketing, photography, or other activities requiring separate permission.

No provision of these Terms limits a right or remedy that cannot lawfully be waived.

3. Eligibility and accounts

You must be at least 18 years old to independently enter into these Terms or purchase Services. Participation by anyone under 18 requires advance studio approval, compliance with the age requirements for the specific class or event, and completion of the applicable consent documents by a parent or legal guardian. Do not register a minor for a class without first contacting us.

Provide accurate account and payment information and keep it current. Keep your password confidential, use your own account to book, and notify us promptly if you suspect unauthorized access. You are responsible for activity you authorize through your account; responsibility for unauthorized activity will be determined under applicable law.

Memberships and class credits are personal and may not be shared, resold, or transferred unless the applicable offer expressly allows it. Guest passes must be used through the designated guest booking process.

4. Classes, reservations, and attendance

The Apartment offers movement experiences that may include heated yoga, mat Pilates, Yoga Sculpt, kettlebell flow, mobility, restorative practice, and specialty events. Formats, instructors, schedules, equipment, and room conditions may vary.

Reservations are subject to capacity and the booking rules shown for your purchase. Unlimited access means access to eligible classes within your plan, subject to availability; it does not guarantee a place in a particular class. Access to locations, guest benefits, and access to The Garage Chicago depend on your specific membership or offer.

Arrive with enough time to check in and prepare. Follow staff instructions and the arrival policy displayed for your class. We may decline late entry when it would disrupt the class or compromise safety. A reservation does not guarantee admission if you fail to meet the disclosed arrival requirements.

Waitlist enrollment does not guarantee a space. Any automatic enrollment deadline and cancellation obligations must be disclosed in the booking process. Check your reservation status and notifications before attending.

5. Class cancellation and no-show policy

Unless different terms are clearly disclosed for a particular booking:

  • Cancel at least 12 hours before the scheduled class start time to avoid a late cancellation fee.

  • A cancellation within 12 hours of the start time is subject to an $18 late cancellation fee.

  • Missing a reserved class without canceling incurs a $35 no-show fee.

The late cancellation and no-show fees are alternatives for the same reservation, not cumulative fees. Any additional effect on a class credit must be disclosed in your purchase or booking terms. Fees apply only where disclosed and authorized and are subject to applicable law.

Cancel through the booking platform used to reserve your class. If a technical problem prevents cancellation, contact info@theapartmentchi.com promptly with your name and class details. Exceptions may be considered on a case-by-case basis; no exception changes the general policy.

Bookings through ClassPass or another third-party provider are subject to the cancellation and payment rules disclosed by that provider. Contact the provider about charges it collects.

Canceling a class reservation does not cancel a membership. Membership cancellation is addressed below.

6. Purchases, billing, and recurring memberships

Prices are in U.S. dollars. Applicable taxes and any additional charges will be disclosed before purchase. The purchase terms will identify included Services, eligible locations, activation dates, expiration dates, refund conditions, and any minimum commitment.

A recurring membership renews and your authorized payment method is charged at the amount and frequency disclosed when you enroll, unless you cancel in accordance with your membership agreement and applicable law. Before enrollment, we will disclose renewal terms, any promotional period and subsequent price, and how to cancel. We will obtain the required consent and provide an acknowledgment you can retain.

Introductory offers renew only when recurring billing is clearly disclosed and separately authorized. A one-time purchase does not become a subscription merely because you accept these Terms.

To cancel a recurring membership, email info@theapartmentchi.com with your full name, the email address associated with your account, and a clear request to cancel your membership. The applicable agreement must state when ordinary cancellation takes effect and any permitted notice requirement. Online enrollment will have an online cancellation method as required by law. We will provide confirmation of your cancellation.

Not attending classes, deleting the app, or canceling a reservation does not end recurring billing. A payment failure does not substitute for a cancellation request. We may suspend access while an undisputed payment remains overdue, subject to your contract and applicable law.

Membership pauses, transfers, and ordinary refunds are governed by the terms provided at the time of purchase. Nothing in a “nonrefundable” policy overrides statutory cancellation or refund rights. We will provide any notices required for renewals, promotional conversions, or pricing changes. Changes will not retroactively increase a charge already agreed to.

7. Illinois fitness contract cancellation rights

Where the Illinois Physical Fitness Services Act applies, these rights supplement your contract:

Initial cancellation: You may cancel within three business days after the first business day following your signing of the contract and receive a refund of all money paid under it. For this purpose, a business day is a day the facility is open for business.

Relocation: If you move more than 25 miles from the center’s facilities and the original center does not designate a comparable center within 25 miles of your new residence that agrees to accept the original contract obligations, you may cancel. You are responsible only for charges allocable to the time before reasonable evidence of relocation is presented, plus any fee expressly permitted by the contract and law. Any such fee may not exceed the lesser of 10% of the unused balance or $50.

Death or disability: If death or disability prevents use or receipt of all contracted Services, you or your estate are responsible only for charges allocable to the time before death or the onset of disability.

Notice of cancellation under these rights must be in writing. It may be delivered by certified or registered mail to The Apartment Chicago, 2503 W Chicago Ave, Chicago, IL 60622, online through [website cancellation link to be confirmed] if the contract was entered into online, or to info@theapartmentchi.com if that email is provided in the contract. Required refunds will be made within 30 days. These rights must also be included in the applicable written fitness services contract, a copy of which will be provided to you.

8. Promotions, gift cards, and merchandise

Promotions, referrals, guest passes, and introductory offers are subject to the eligibility, duration, and restrictions disclosed with the offer. Do not create duplicate accounts or misrepresent eligibility to obtain a benefit. A promotion does not change an existing membership unless expressly stated.

Gift card expiration, fees, redemption, and cash redemption are governed by the terms supplied with the card and applicable law. Merchandise returns and event refunds are governed by the policy disclosed before purchase, subject to legal rights.

If we cannot fulfill a paid order, we will notify you and refund the unfulfilled portion. We will not charge a higher price to correct an error without your agreement.

9. Participation, heat, and personal safety

Movement and exercise involve risks. Heated classes may increase the risk of dehydration, overheating, dizziness, or fainting. Other risks may include falls, strains, equipment-related injury, and exposure to communicable illness.

Choose classes appropriate to your experience and condition. Consult a qualified healthcare professional if you are unsure whether exercise or heated practice is appropriate for you, including during pregnancy or while managing an injury, illness, or medication affecting heat tolerance.

You may rest, modify, decline an exercise or hands-on adjustment, or leave the room at any time. Stop and alert staff if you feel unwell or unsafe. Follow equipment and safety instructions, and do not attend while impaired or when you reasonably believe you have a contagious illness that could put others at risk.

Our instructors provide movement instruction, not medical diagnosis or treatment. We do not guarantee particular fitness or health outcomes.

Participation may require a separately signed assumption-of-risk and liability waiver. These Terms do not independently release claims for physical injury or replace that waiver.

10. Respect for the studio and community

Treat staff and other participants respectfully. Harassment, discrimination, threats, violence, unwanted contact, and deliberate property damage are prohibited. Follow posted rules, respect shared equipment, and report safety concerns promptly.

Do not photograph or record another person without permission. Recording is prohibited in bathrooms and changing areas. Commercial filming or photography requires our advance written approval.

We may stop participation or suspend access when reasonably necessary to address unsafe conduct, serious policy violations, or unlawful activity. Any termination, remaining charges, or refunds will be handled under your agreement and applicable law.

Keep your belongings secure. Storage areas are provided for convenience and do not guarantee protection from loss or theft. Responsibility for loss or damage is determined under applicable law.

11. Photography and marketing communications

Where we seek to use an identifiable participant’s image, voice, or likeness in promotional materials, we will obtain the appropriate separate consent or release. Purchasing a membership or accepting these Terms does not by itself grant an unrestricted promotional image license.

We may send service-related messages about reservations, account activity, and billing through the channels you provide, consistent with applicable law and your preferences.

Marketing emails and texts require any consent mandated by law. Marketing consent is not a condition of purchase. Email recipients may use the unsubscribe link. If you separately enroll in our marketing text program, message frequency varies, message and data rates may apply, and you may reply STOP to opt out or HELP for assistance. Additional messaging terms and the Privacy Policy will be provided at enrollment. Opting out of marketing does not cancel a membership.

12. Intellectual property and permitted use

Our branding, original website content, photography, videos, and other materials are owned by us or used with permission. You may access them for personal, lawful use. Do not reproduce, sell, distribute, or commercially exploit protected materials without permission, except as permitted by law.

Do not interfere with the Services, bypass security, introduce malicious code, access another person’s account, or use automated tools to extract restricted account information. Report suspected infringement or security concerns to info@theapartmentchi.com.

If a feature allows you to submit content, submit only material you have the right to share. You retain ownership and give us permission to display and process it as reasonably needed to operate that feature. Promotional reuse of identifiable testimonials or images requires appropriate permission. Nothing here prohibits honest reviews or lawful criticism.

13. Third-party platforms

Booking, payment, or other features may use third-party platforms, including Mariana Tek and ClassPass. Your use of those platforms may be subject to their own terms and privacy policies. We do not control unrelated third-party websites or promise their uninterrupted availability. These Terms do not eliminate our obligations for Services we sell or provide.

14. Service changes and digital disclaimers

We may change instructors, class schedules, formats, or facilities for operational or safety reasons. If we cancel a class, you will not incur a late cancellation or no-show fee, and any credit used for that reservation will be restored. Refunds for canceled paid events and remedies for material reductions in contracted Services will be handled under the applicable agreement and law.

To the extent permitted by law, our website and digital features are provided “as is” and “as available,” without a guarantee of uninterrupted or error-free operation. This does not remove express commitments in a purchase agreement or mandatory consumer protections.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of our digital Services. This limitation does not apply to physical injury, fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Liability for in-person participation is addressed in the separately accepted participation agreement and applicable law.

15. Disputes and governing law

Please contact info@theapartmentchi.com with a description of any concern and your requested resolution so we can attempt to resolve it. Doing so is encouraged but does not prevent you from seeking legal relief or contacting a government agency.

Illinois law governs these Terms, subject to any mandatory law applicable to you. Unless applicable law requires otherwise, court proceedings concerning these Terms may be brought in a court with jurisdiction in Cook County, Illinois. These Terms do not impose mandatory arbitration or a waiver of class action rights.

16. Updates and general provisions

We may update these Terms prospectively and will show the updated date. We will provide notice of material changes and obtain renewed consent where required by law. An update does not retroactively change an existing dispute or override a separately accepted membership agreement.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our decision not to enforce a provision on one occasion does not waive future enforcement. Any assignment of our contractual obligations remains subject to applicable law and does not reduce your protected rights.

These Terms and the specific agreements you accept govern their respective subjects. They do not replace required purchase disclosures or other nonwaivable protections.
